The Property located at 2030 St. Clair St. in Hamilton, Ohio 45013 is to be auctioned off with owner confirmation. Pre-bids will be available until June 30th at 10:00 am. The live Auction will take place on June 30th at 12:00 noon. Bidding can be done in person and online.
Special Note- Buyers Premium is 8% on this property, If you have an agent, they must register you prior to you registering on Hibid or in person. Property sells with Owner confirmation. Real Estate Auction Terms and conditions 1. Registration and deposits Although there is no obligation to bid, all prospective buyers must register in order to bid at the auction sale. This is true for both online and live auctions. A deposit of 5% of the purchase price will be collected immediately following the sale for live auctions and within 24 hours of online auctions. These funds must be wired or made by certified check. A personal or business check may be used if prior authorization from auction company is received. Checks will be made out to CENTURY 21 Thacker & Associates, Inc. These funds will be deposited into the Real Estate Brokers non-interest bearing trust/escrow account. These funds will be credited to the buyer at the closing. The property should close in Thirty (30) days unless other terms are posted in the listing. The deposit is non-refundable for any reason. The deposit will be forfeited if closing does not happen by closing date. 2. Auction Type Properties may be offered through any of the following auction methods. The auctioneer reserves the right to withdraw any property from the auction, up to the start of the auction without penalty including absolute auctions. a. Absolute Auction- the property will be sold to the highest bidder regardless of price. b. Minimum Bid- the property will be sold to the highest bidder at or above the published price. c. Reserve/Seller conformation- The seller has the right to accept or reject the highest bid. 3. Conditions of the Auction The Auctioneer’s decision is final in the event of any dispute over any auction matter. The Auctioneer reserves the right to accept bids in any increments he feels are in the best interest of his clients and reserves the right to waive any previous printed or announced requirements. All auction day announcements by the Auctioneer supersede any printed material or any other auction statements made previously. The Auctioneer reserves the right to bid on behalf of any buyer. All auction sales contracts will be presented to the seller for approval. The Auctioneer reserves the right to withdraw any property including absolute sales from the auction, without penalty. Auctioneer reserves the right to cancel the auction, without penalty if the auctioneer believes the outcome will not be in the seller’s best interest. If Seller is not present, the Auctioneer may elect to start or cancel the sale without penalty. The Auctioneer shall be held harmless by the buyer and seller should the property fail to go to successful settlement for any reason. The Seller, Auctioneer, CENTURY 21 Thacker & Associates, Inc, and any of its agents shall not be held liable for any errors and omissions regarding auction property. Buyer assumes the responsibility to check with the appropriate authority/authorities regarding the properties zoning and current and future intended use as wells as restrictions and covenants affecting the property. Bidder(s) have the right and should examine the applicable county master plan and any municipal land use plans and maps for the area the property is located prior to bidding. The Seller, Auctioneer, CENTURY 21 Thacker & associates, and any of its agents assume no responsibility for the information contained in such plans and maps, and assumes no liability for failure of the buyers to review the plans and maps. The contract will not be contingent upon bidder(s) reviewing such plans and maps. Auctioneer complies with all federal, state, and local laws regarding the buying and selling of property. 4. Buyer’s premium A eight percent (8%) buyers premium will be added to the final bid to establish the final contract price. It is clearly understood by the Buyer, that the Auctioneer represents the seller and that this buyer’s premium in no way implies and agency relationship between the Auctioneer and Buyer 5. Mortgage Financing Financing is not a condition of the purchase contract. It is recommended that the bidder does his due diligence in regards to being able to perform within the allotted closing period. The contract will be written as a cash contract. There will be no contingencies for appraisals or inspections. Deposit will be forfeited if failure to close for any reason. 6. Property inspection Bidder acknowledges that he or his agent has inspected the property and will be purchasing the property “as is-where is”. Property may only be inspected during the posted inspection periods or with written approval from Auctioneer. 7. Warranties There are no expressed or implied warranties on the property. The property is sold “As is Where Is”. 8. Forms Bidder acknowledges that he has reviewed the appropriate forms as may be required by the state of Ohio. A. Property Disclosure form B. Disclosure of Agency relationships C. The disclosure of information and acknowledgement / lead base paint and/or lead base paint hazards required under Title X for homes built prior to 1978. If successful Bidder, Bidder agrees to execute all necessary forms within 24 hours of accepted bid. 9.
