By registering and bidding on this auction, you are agreeing to these terms and conditions (the "Terms") which govern your access to these online auction services (the "Services") and agree to be bound by all Terms listed below. 1. Defined Terms:
"Winning Bidder" and "you" refers to the person or entity with the highest bid at close of the auction
"Auctioneer" and "we" are defined as Boyd Auction Company LLC
"Seller" refers to the person or entity providing the Goods for auction
"Goods" means all items available for bid in this auction
"auction" refers to the public auction as noted in the auction description
"lot" or "item" refers to the Goods described by lot number
"bid" refers to the offer to purchase a lot at the specific stated price
2. Eligibilty: You must be at least 18 years of age to participate in our auctions. By using these Services, you affirm that you are of legal age to enter into these Terms and you represent that you are legally able to purchase items.
3. Registration: You agree that all information provided during registration was complete, accurate and current. You are responsible for ensuring that all information provided is kept current.
4. Bidding: By placing a bid on a lot, you are committing to purchasing the lot at the price of your bid plus any buyer's premium, fees, or other costs as stated if you are the Winning Bidder. You are responsible for reading and understanding ALL information related to the lot and auction services provided. Once you have placed a bid it cannot be retracted except at our discretion and only under extraordinary circumstances. The Auctioneer reserves the right to reject any bid placed for any reason and will notify the bidder in the event a bid is rejected.
5. Payment: If you are a Winning Bidder you will receive an email within 48 hours of the end of the auction containing the lots won as well as any additional payment and pickup instructions. All payments will be made in accordance with "Payment Information" as shown on the auction information page. Payment must be made before items can be picked up. If you do not receive the email, please contact us a david@boydauctionco.com.
6. Pick-Up: All items will be available at the location specified in the pick-up instructions unless otherwise specified in the auction listing. If you are the Winning Bidder, you will be responsible for arriving at the appointed time and ensuring you have the ability to pick-up the items, which includes an appropriate vehicle and help for heavy or large items. Failure to show up at your appointed time will be considered a default and Seller and Auctioneer will pursue all legal remedies available under the laws of the State of Illinois, including recovery of reasonable attorney fee. If a late pickup is desired, a $5 a day storage fee will be assessed to the Winning Bidder and any item left for longer than 10 days will become the property of the Auctioneer. Forfeiture of the item due to non-pickup does not relieve the Winning Bidder of their payment obligation. Auctioneer reserves the right to resell any forfeited items and no payment will be made to the Winner Bidder who forfeited the items.
7. Shipping and Handling: Items available for shipping will be labeled as such in the auction. Instructions for notifying us that you require shipping will be included in the after auction email. Shipments are typically made within 5 to 7 days of notification that shipping will be required. We will ONLY ship to the verified address on file with your credit card company, no exceptions will be made to this policy.
8. Goods sold "as is": All Goods are sold in "as-is" condition, with all faults and without any warranties of any kind, expressed or implied. We do our best to ensure that all relevant information is provided in the pictures and auction listing, but ultimately you are responsible for inspecting the items and the Seller and Auctioneer accept assume no liability for errors or omissions in listings. In most cases Auctioneer does not test or verify the working condition of items offered for sale or open and inspect lots offered as New in Box or Renewed. Preview times will be available for all lots unless stated otherwise in the auction descrption.
9. Regulations and Taxes: You are responsible for compliance with any and all local, state, or federal regulations with regards to your purchase as well as any associated taxes or fees.
10. Changes to the Service or Terms: Auctioneer reserves the right to change the terms of this auction as well as remove any items offered for sale at their discretion.
11. Liability: Winning Bidder agrees to indemnify and hold harmless Seller and Boyd Auction Company LLC and its members, partners, officers, directors, employees, agents, successors and assigns, from, and against, any and all causes of action, suits, claims, demands, judgments, liabilities, losses, damages, awards, penalties, fines, costs and expenses (including, but not limited to, reasonable attorney's fees), arising out of, relating to, or resulting from the use of any Goods purchased through this online auction.
12. Buyers Premium: Any applicable buyer's premiums will be listed in the auction terms.
