Please represent your items to the office staff when you check in. Sales tax of 6.25% applies on certain items, see the full description of an item to confirm. Sales tax of VUT OR IST applies on all titled items- see full terms for details.
1. Bidder Registration: Martin Auction reserves the right to accept or reject any bidder they deem unfit, whether at an in-person or online auction. Reasons for rejection may include a history of non-payment, questionable identity verification, perceived mental instability, rude or disorderly conduct, or any other reason deemed appropriate by Martin Auction. No refunds or compensation will be provided for travel or any expenses incurred by the rejected bidder. Bidders will recieve 2. Liability for Purchases: I understand that I am liable for all purchases made using my registered buyer number. I agree to settle all purchases, including applicable sales tax (6.25%), buyer premium, and title handling fees, on auction day (for in-person bidders) or by the end of the next business day (for online bidders). A late fee may be added to my invoice if payment is delayed. Failure to pay promptly and communicate with the auction company may result in the sale being voided and reported as non-payment. 3. Item Inspection: I acknowledge the opportunity to inspect all items before the auction and agree to pay for all items I win. I understand that items are sold AS-IS, with potential faults or operational issues. There are NO REFUNDS, and I accept all risks if I choose not to inspect items before bidding. Details such as makes, models, years, serial numbers, etc. are subject to verification by me as the bidder/buyer. Buyer Beware! 4. Payment Terms: I agree to make full payment before removing items from the auction site. Cash is preferred; handling charges may apply to credit card transactions. Cashiers Checks may be presented and will be verified. No personal/business checks without pre-approval. Wire transfers are accepted by the end of the next business day (items remain on lot until payment confirmation). Online-only bidders authorize their credit card on file with the third-party platform to be charged within 24-48 hours of invoicing and agree to pay with NO CHARGEBACKS. Non-executing bidders will be reported and may be barred from bidding at future auctions. 5. Tax and Title Responsibilities: I understand that items with a title are subject to Illinois Sales Tax or Vehicle Use Tax. I appoint Martin Auction Services LLC to act as my lawful power of attorney to sign all necessary papers for Illinois title and/or registration or transfer of any vehicle listed on the paid invoice. A title handling fee applies per title. Only titles on lots paid for by cash will be released upon payment. I agree that all Title and Registration FEES ARE NOT REFUNDABLE once the application is submitted to the state. 6. As-Is Sale and Waivers: All auction lots are sold "As Is - Where Is". Warranties or guarantees are strictly between the buyer and seller, not Martin Auction. If warranty issues arise, arbitration would involve returning the item to Martin Auction for a refund; the bidder is responsible for all hauling expenses. Buyers agree to sign WAIVERS for items requiring them before release. 7. Off-Site Items: Items located off-site will be clearly listed in the description and must be picked up from the specified location. 8. Risk and Insurance: Martin Auction assumes no responsibility for accidents, stolen, or damaged property. Items left at the auction site are at the owner's risk and should be insured as desired by the bidder on the day of sale. 9. Auctioneer Authority: The auctioneer in charge will resolve any bidding disputes, and their decision will be final. The auctioneer reserves the right to accept or reject bids at their discretion. All announcements made on auction day take precedence over printed materials, and any item may be removed from auction without prior notice. 10. Use of Personal Information: I understand that any personal or business information provided (email, phone, etc.) may be used for communication and marketing purposes only and will not be sold to third parties. 11. Jurisdiction: I agree that any legal disputes arising from the auction must be filed and tried in DeWitt County, Illinois. 12. Default and Collection: I understand that Martin Auction reserves the right to collect attorney fees, interest, and collection costs if I default on any transaction(s) at this auction. I agree to pay these costs if necessary. The Buyer agrees to indemnify and hold Martin Auction harmless from any costs, losses, liabilities, or expenses, including attorney fees, arising from Martin Auction being involved in legal actions due to the Bidder's or Seller's failure to fulfill their obligations under this contractual agreement. 13. Storage & Fees: Paid Items remaining after 5 business days may be resold or disposed of by Martin Auction. I agree that such items are forfeited without reimbursement. If (titled) items remain beyond 5 days, I agree to pay $10.00 per day per item, which may be deducted from auction proceeds when the item is sold. Standard commission rates may apply. * Specific timelines for item storage may vary and will be noted in auction information. 14. Shipping Policy: Martin Auction does not provide shipping services. Buyers may arrange shipping through a preferred shipper who picks up items regularly from our location. Martin Auction is not affiliated with any shipping provider, and inquiries regarding shipping details should be directed to the shipping company, not Martin Auction. Loading hours, 9:00 am to 4:00 pm on weekdays. No Saturday or Sunday loading. Loader assistance will be available for 5 business days before/after a regularly scheduled auction from 9 am to 4 pm, Monday through Friday. Any difficulty in retrieving your items should be made known to Martin Auction. Payment Terms
Live In Person bidders: Payment is due on Auction day. Online BIdders: Payment is due by 3 PM on the following Monday via wire transfer. We will send wire instructions with your invoices immediately following the auction.
All shipping is the responsibility of the Buyer. Please make your trucking arrangements as Martin Auction does not ship.
